Intellectual property and counterfeits

On Vinted, you can only sell authentic items — all counterfeit items are strictly prohibited.

We aim to keep Vinted a trustworthy and safe platform for our members by ensuring that everyone complies with all applicable laws and intellectual property regulations.

I. Trademark and Design

What is a trademark and design?

A trademark is a sign (e.g. a word, phrase, logo, symbol, sound, or a combination of these) that a company uses to identify its products or services and distinguish them from other companies’ products or services. It indicates the origin of goods by allowing consumers to associate a specific company and its manufactured items with a particular trademark.

A design protects the visual appearance of a product or item (e.g. its shape, pattern, material, etc.) and gives the right holder exclusive rights for that appearance.

A trademark or design holder may allow others to use its trademark or design by licensing them and may prohibit others from using them without its consent.

How a trademark or design is obtained

To be eligible for trademark protection, the sign must be distinctive. The scope of protection of the registered trademark is limited to the countries and regions covered by the trademark registration as well as the products and services listed therein.

To be eligible for design protection, the product must be new and have individual character. The scope of protection of the registered design is limited to the countries and regions covered by the design registration.

Counterfeits

Counterfeiting (or replicating) is a type of trademark/design infringement. It’s used to designate exact copies of a specific product or its parts (e.g. a shape, pattern, logo, etc.) protected by trademark and/or design rights.

Manufacturing, distributing, selling, or promoting counterfeit items is illegal and may lead to civil or criminal penalties. Even if the seller openly states that their item is counterfeit or if they admit they cannot guarantee the item’s authenticity, selling counterfeit items is still illegal.

Be aware that counterfeit items are often manufactured through organised criminal networks. Such items generally are of poor quality. Additionally, having been manufactured without adhering to the brand’s standards, such items could be harmful or unsafe for consumers.

Can I use a brand’s trademark in my listing?

Items that bear a company's official brand name or logo can be listed on Vinted as long as the products were lawfully made by, for, or with the consent of that company.

This means that when selling an authentic item, you can use a trademarked name to list and describe such item, and only for this purpose. You can only do so if your item is authentic and you’re 100% sure it is.

Using multiple brand names in a listing

To advertise your listing, you can only use the trademark of your item. Using other brand names in the item description or as hashtags for better search results or to benefit from the reputation of these brands isn’t allowed.

Using a particular brand’s trademark to compare your listed item with this brand’s products is not recommended either.


II. Copyright

What is copyright?

Copyright is legal protection granted to the authors of original works expressed and fixed in any tangible form. Copyright protection may apply to such works as pictures, text, videos, photographs, product design, music, movies, etc. A copyright owner may prevent others from using its work without permission.

In most cases, tangible original work does not need to be filed or registered for copyright protection to be effective and enforceable.

Use of third-party photos

Using photos or texts without the owner's permission could result in copyright infringement. If you use a text or a photo taken/created/published by someone else, you must have permission to do so.

Here are some examples of potentially illegal uses:

  • Using pictures of a brand website to illustrate your item of that particular brand
  • Copying pictures from other websites or internet searches

Good to know

  • All items listed on Vinted must be authentic. If you have any doubt about your item’s authenticity, please do not upload it.
  • Listing counterfeit items on Vinted can lead to your account being suspended or permanently blocked.
  • Make sure you take and upload your own photos showing your item’s authenticity clearly. For more details, please check what photos you should take and review our item authenticity policy.
  • If you spot an item that does not seem to be authentic, please report it to us.
  • If needed, we will cooperate with brand owners and law enforcement authorities to tackle any illegal activities that might take place on Vinted.
